2. Service Policy

  • Employers: May post jobs, review candidates, and are responsible for accuracy of job postings and timely payment.

  • Headhunters: May submit candidates and earn commissions on successful placements. Submissions must be accurate and verifiable.

  • Candidates: May create free profiles, apply to jobs, and retain full rights to access, update, or withdraw their information.

3. User Responsibilities

  • No fraudulent, misleading, or discriminatory use of the platform.

  • Respect intellectual property, privacy, and personal rights of others.

  • Accounts may be suspended or terminated for violations.

4. Data Privacy & Protection

Ant-Tech Asia protects user data under international standards:

  • Vietnam: Complies with the Cybersecurity Law 2018 and Personal Data Protection Decree 13/2023/ND-CP.

  • European Union: GDPR (Regulation (EU) 2016/679) – rights to access, rectify, erase, restrict, and transfer data.

  • United States:

    • CCPA (California Consumer Privacy Act, 2018) and CPRA (2023) – rights to know, delete, and opt-out of data sale.

    • HIPAA (1996) – for healthcare-related candidate information.

  • International: OECD Privacy Guidelines, APEC Privacy Framework.

Encryption, firewalls, and security audits are applied to protect data.

5. Intellectual Property & Copyright

  • All platform content, branding, databases, and technology belong to ANT-TECH Co., Ltd.

  • Protected under:

    • WIPO Copyright Treaty

    • TRIPS Agreement (1994)

    • U.S. Copyright Act (1976)

    • EU Intellectual Property Directives

Users may not copy, distribute, or modify content without written consent.

6. Compliance with International Laws

Users agree to comply with:

  • Vietnamese laws on e-commerce and cybersecurity.

  • EU laws including GDPR and Digital Services Act (2022).

  • U.S. laws including CCPA, CAN-SPAM Act (2003), and FTC regulations.

  • Any other applicable international trade, labor, and privacy laws.

7. Limitation of Liability

  • ANT-TECH Co., Ltd is not liable for indirect, incidental, or consequential damages.

  • Total liability is limited to referral fees or service fees paid in the last 12 months.

  • Platform may experience downtime; no guarantee of uninterrupted service.

8. Termination

  • Either party may terminate service with written notice.

  • ANT-TECH Asia may suspend or close accounts for fraudulent, illegal, or abusive activity.

  • Upon termination, all rights to use Ant-Tech Asia services cease immediately.

This Agreement shall be governed by the laws of Vietnam, the European Union, and the United States, where applicable, and interpreted in accordance with international conventions on privacy and intellectual property.
